SECTION 1 – TERMS OF USING THE SITE

 

This website (https://www.premiumcbdlabs.com/) (“Site”) is owned and operated by Premium CBD Labs LLC (the “Company”).  The following privacy policy describes how Company collects, uses, shares and protects information about its customers and visitors through our Site and the services offered by the Company (“Services”).  Use of the Site and receipt of the Services are also subject to Company’s Terms and Conditions of Use. By accessing this Site, you acknowledge that you have read, understood, and agree to be bound by this privacy policy.  All users of the Site must be 18 or older; Company does not knowingly collect any personally-identifiable information from children under the age of 13. If you think that your child provided this kind of information on our Site, we strongly encourage you to contact us immediately and we will try to promptly remove such information from our records.  If you do not agree with any of these terms, you are prohibited from using or accessing this site. Additionally, the Site may also contain links to third party sites that are not owned or controlled by Company. Please be aware that we are not responsible for the privacy practices of such other sites. We encourage you to be aware when you leave the Site and to read the privacy statements of each and every website that collects personal information.

 

SECTION 2 - WHAT DO WE DO WITH YOUR INFORMATION?

 

When you create a new account or send us a message on the Site we collect the personal information that you entered. This information may include, but is not limited to: full name, business name, addresses, email address, phone numbers, username and password, order content and message content, hemp license copy and number, type of business.  Company also collects potentially personally-identifying information like Internet Protocol (IP) addresses for logged in users to help learn about your browser and operating system.  We do not share any of your above information with third parties except as explained in this Privacy Policy.

 

Your personal information may be sent to and held by our third-party service providers, such as mailing services (like USPS), credit card/payment gateway providers (such as Square), employees, contractors and affiliated organizations that (i) need to know that information in order to process it on Company’s behalf or to provide services available at Company’s Site, and (ii) that have agreed not to disclose it to others. Company expressly reserves the right to change these services, providers, employees, contractors, and affiliates from time to time in its sole discretion.  Some of those employees, contractors and affiliated organizations may be located outside of your home country; by using Company’s Site, you consent to the transfer of such information to them. Company will not rent or sell potentially personally-identifying and personally-identifying information to anyone.

The Company uses Google Analytics, cookies, or similar software to help us learn about who visits our site and what pages are being looked at.  These cookies are used to store information including visitors’ preferences, and the pages on the Site that the visitor accessed or visited. The information is used to optimize the users’ experience by customizing our web page content based on visitors’ browser type and/or other information. Company reserves the right to utilize cookies to track various Site visitor activity and information. Users who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before using Company’s Site, with the drawback that certain features of Company’s Site may not function properly without the aid of cookies.

SECTION 10 - CALIFORNIA PRIVACY RIGHTS

Under California’s "Shine the Light" law, California residents who provide personal information in obtaining products or services for personal, family or household use are entitled to request and obtain from us once a calendar year information about the customer information we shared, if any, with other businesses for their own direct marketing uses. If applicable, this information would include the categories of customer information and the names and addresses of those businesses with which we shared customer information for the immediately prior calendar year (e.g. requests made in 2019 will receive information regarding 2018 sharing activities).

To obtain this information, please contact us with “Request for California Privacy Information” on the subject line and in the body of your message and provide a telephone number where you can be reached. The Company will first call to verify the validity of the request and will then provide the requested information as promptly as possible. Please be aware that not all information sharing is covered by the "Shine the Light" requirements and only information on covered sharing will be included in our response.

 

 

SECTION 11–CONSENT TO PROCESSING OF PERSONAL DATA IN UNITED STATES

SECTION 13 – GOVERNING LAW

 

Any controversy, claim or dispute arising out of or relating to this Privacy Policy or the relationship, either during the existence of the relationship or afterward, between the Company and any visitor to this Site or users hereto, their assignees, affiliates, attorneys, or agents, shall be governed by and construed in accordance with the internal laws of the State of Wisconsin, without regard to its conflict of laws principles or rules of construction concerning the draftsman hereof, and shall be litigated solely in state court in Dane County, Wisconsin or the United States District Court for the Western District of Wisconsin. Each Party (1) submits to the jurisdiction of such court, and (2) waives the defense of an inconvenient forum.
